August 11, 2026, Regular Board Meeting Agenda
On July 28, 2026, The Board of Trustees did the the first reading to an Ordinance. The second reading will be during the August 11, 2026 meeting, 5:00 pm. It reads:
ORDINANCE 141 – 1.03 C 2026 – METER PIT REQUIREMENTS
AN ORDINANCE TO REPEAL ORDINANCE 141A5 AND REPLACE ORDINANCE 141 SECTION 1.03 C and 1.03 D WITH:
ORDINANCE 141 – 1.03 C 2026 - METER PIT REQUIREMENTS
BE IT ORDAINED TO REPLACE SECTION 1.03 C WITH
SECTION 1.03 C 2026 METER PIT REQUIRMENTS TO ORDINANCE 141.
(1) All dwellings or places supplied with water from the town water system shall be metered.
(2) Meters shall be installed only in a basement that is protected from frost and other damage and that remains accessible for examination and maintenance. Crawl spaces, slab-on-grade construction, and any other location outside a basement of the building are not permissible for meter installation.
When a basement meeting these requirements does not exist or cannot be used, a manufactured meter pit shall be installed. A suitable place for the meter and meter pit, safe from frost or other damage and accessible for examination, will be provided by and at the expense of the City of Egan. All plumbing and expenses from the meter pit to the residence will be at the owner’s expense.
If a meter is injured by freezing within the basement or is otherwise damaged by the act or neglect of the owner or occupant, it shall be repaired or replaced at the expense of the owner or occupant. If a meter is injured by freezing within the meter pit, it shall be repaired or replaced at the expense of the City of Egan. If the owner or occupant neglects or refuses to repair or replace the meter, or refuses to pay the related expenses, the water supply may be turned off and shall not be restored until all costs and the applicable reconnect fee have been paid. Unpaid costs may be collected in the same manner as other utility charges and may become a lien or collection against the property/owner.
(3) The town will supply meters to all accounts where applicable, so meters are compatible with the town’s computer read system. The meters are the property of the City of Egan/Big Sioux Water.
(4) Manufactured meter pits shall be required for all new construction that does not have a basement or a modular/mobile home that uses residential sized meters and shall be located within 1 foot of the users lot line where possible or in a place designated by the Public Works supervisor where lot line placement is not feasible. The pit shall be of a type approved by the Public Works supervisor, installed according to manufacturer specifications, and shall remain fully accessible at all times (no permanent landscaping, structures, or coverings that obstruct access will be allowed.)
(5) The Egan City Board of Trustees may hear and decide appeals where it is alleged there is an error in any order, requirement, decision or determination made by an administrative official in the enforcement of this chapter or of any ordinance adopted pursuant thereto.
(6) Except as otherwise provided herein, any person violating any provision of this chapter shall be subjected to 30 days imprisonment in a county jail or $500 fine, or both. In addition to the sentence that is imposed herein, the defendant shall make restitution to the to the City of Egan.
